1. General Information

These Terms & Conditions ("Terms") govern the use of the Easy Flow Builder platform, operated by Mediaplatforms B.V., located at Weidebloemenlaan 163, 3448HC, Woerden, Netherlands (KvK number: 82415889). By using Easy Flow Builder, you agree to these Terms.

These Terms are legally binding under Dutch law, and any disputes shall be submitted to the competent court in Arnhem, the Netherlands.

2. Service Description & Eligibility

Easy Flow Builder is a SaaS platform that allows WhatsApp Business users to create automated message flows for customer communication. A "flow" consists of a sequence of WhatsApp messages triggered by user responses and logic settings.

To use the service, users must:

• Be a business entity with a WhatsApp Business account.
• Create an account on Easy Flow Builder.

Prohibited activities include but are not limited to:

• Sending spam or unsolicited messages.
• Engaging in illegal activities or violating WhatsApp's policies.

Misuse of the platform may result in immediate termination of access without refund.

3. Pricing & Payment Terms

Easy Flow Builder is a paid service with a 30-day trial period. After this period, users must subscribe to a monthly or annual plan.

• Payment is processed exclusively via Stripe.
• Monthly payments are charged on the 1st day of each month.
• If a payment fails, the service will be paused after 7 days until a successful payment is made.
• No refunds are provided for any payments, including annual plans.

4. Intellectual Property

• Users retain full ownership of the flows they create.
• Easy Flow Builder does not claim rights over user-created content.
• Users are responsible for ensuring they have the necessary rights to process and send messages via WhatsApp.
• Easy Flow Builder may use user feedback (but not flow content itself) to improve its services.

5. Privacy & Data Processing

• Users must explicitly accept the Privacy Policy upon registration.
• By accepting these Terms, users automatically accept the Data Processing Agreement (DPA).
• Users are responsible for the data they process through Easy Flow Builder.
• Personal data is processed in compliance with applicable privacy laws.

6. Liability & Uptime

• Easy Flow Builder strives for maximum uptime but does not guarantee 100% uptime.
• There is no liability for indirect damages, data loss, or service interruptions.
• Service disruptions caused by third parties (e.g., Twilio, WhatsApp) are not Easy Flow Builder's responsibility.
• Easy Flow Builder will make reasonable efforts to notify users of issues and resolve problems within its capabilities.

7. Termination & Account Cancellation

• Users can cancel their account at any time, but no refunds are issued for early cancellations.
• Upon cancellation, data will be retained for 30 days before being permanently deleted, except for transaction records required for bookkeeping.
• Users must cancel at least 1 day before renewal to avoid automatic subscription renewal.
• Accounts violating these Terms (e.g., spam, illegal content) may be suspended or terminated without refund.

8. Governing Law & Disputes

These Terms are governed by Dutch law. Any disputes shall be resolved exclusively by the court in Arnhem, Netherlands.

9. Compliance & Updates

• Users must comply with applicable export laws and restrictions.
• Easy Flow Builder may update these Terms. Users will be notified via email, but continued use of the platform constitutes acceptance of the updated Terms.
• Easy Flow Builder will provide a support policy, which will be detailed in future updates.
